What does this Privacy Policy cover?

We are Numbers & Figures LLC (“Numbers & Figures”, “we”, or “us”). This Privacy Policy governs our collection and processing of personal data through every game and interactive experience we operate as a Discord Activity (each, a “Game”, and together with our related websites and support channels, the “Service”).

This Privacy Policy, together with our Terms of Service, describes how we handle your personal data. Please read the Terms of Service as well, for general guidance about your use of the Service.

Discord is a separate company. You access the Service through Discord. Discord’s own terms of service, privacy policy, and community guidelines govern your Discord account, your Discord profile, and everything you do on Discord outside our Games. This Privacy Policy covers only what we do with your personal data. For what Discord does with it, read Discord’s privacy policy at https://discord.com/privacy.

What Information Do We Collect?

We collect and process different types of personal data depending on how you interact with our Service. Here’s an overview of the information we collect:

Contact Information

We do not ask Discord for your email address, and we do not collect one when you play. However, if you contact us for support, to report a problem, or to exercise a privacy right, whether by email or through a report or support link inside a Game, we collect the contact details and the message content you choose to give us. We use them to answer you, to investigate the issue, and to keep a record of the request.

Discord Account and Profile Information

You do not create a separate Numbers & Figures account. You sign in with your Discord account, and Discord shares a limited set of profile information with us, which may include your Discord user ID, your username, your display name, and your avatar. We also receive the Discord server and channel in which you launch a Game, and which other Discord users are taking part in the same session.

We use this information to identify you inside a Game, to place you in a session with the right players, to show your name and avatar to the other players in that session, to enable social and multiplayer features, to enforce platform rules and security measures, and to answer support requests.

Service Usage Information

As you play, we automatically collect information about what you do in a Game, including the sessions you join and how long they last, the actions you take in a Game, your in-Game settings and preferences, and content you submit or create in a Game.

We use this information to provide core functionality, to enable multiplayer features such as matchmaking, to moderate content players submit, and to manage your preferences and settings during a session.

Device and Behavior Information

We automatically collect certain technical and analytic information from you and your device when you use our Service, including your device and browser specifications (device type, browser, operating system, and the Discord client you are using), system information (language and timezone), performance metrics (crashes, errors, load times, latency), and usage patterns (features accessed and time spent). Our servers receive your IP address, because that is how internet traffic reaches us, and we use it to deliver our Games and to protect against abuse. We do not use it to work out where you are.

We use this information to ensure Service compatibility and performance, improve design and user experience, monitor system stability and performance, prevent fraud and abuse, troubleshoot technical issues, and understand in aggregate how our Games are used.

Voice Chat and What We Hear

Our Games are played in Discord voice channels, and Discord, not us, carries the voice itself. We never receive the audio.

Discord tells us only when someone starts speaking, stops speaking, mutes, or deafens, so the Game can show whose turn it is and keep play moving. Those signals tell us that you spoke. They do not tell us what you said.

Everyone in a Discord voice channel can hear everyone else, and Discord’s own rules govern that channel. Treat voice chat as public to the other players in your session.

Cookies and Local Storage

We do not currently use cookies.

Our Games may store a small amount of information in your browser’s local storage, for example a record that you have already been shown a particular notice, or a setting you chose, so that a Game does not repeat itself every time you open it. Where that storage is strictly necessary to deliver the Game you asked for, we rely on that necessity. Where it is not strictly necessary, we ask for your consent first and the setting is off until you give it. You can clear local storage at any time through your browser or Discord client settings, and doing so may reset your in-Game preferences. We also keep a short-lived session record on our own servers so that a round of play works, which expires when the session ends.

If we begin using cookies or similar technologies, we will update this Privacy Policy and, where the law requires consent, ask for it before we set them.

Gameplay Telemetry and Your Choices

Beyond what is strictly needed to let you play, we may process gameplay telemetry (such as performance and balancing data and technical signals like lag, frame drops, and crashes) to fix problems and improve our Games. While a session is running, this telemetry is linked to you through a session identifier, so during that time it is personal data.

We label analytics events with a randomly generated identifier that exists only for the length of your session. We keep the link between that identifier and your Discord account only while the session is running, and we delete it when the session ends. After that, the events we keep cannot be traced back to you.

We rely on our legitimate interest for this telemetry. You can object at any time by emailing contact@numbersandfigures.com, and we will stop collecting it for you going forward unless we have compelling legitimate grounds that override your objection. We cannot remove telemetry from sessions that have already ended, because we no longer hold anything that links those events to you. We do not store or read non-essential information on your device. If that changes, we will ask for your prior consent and the setting will be off until you give it.

We limit telemetry to what the purpose needs, secure it, and retain it only as long as necessary.

How Do We Share Your Information?

• Technical Service Providers: We share certain personal data with trusted service providers who help us run the Service: to host it and store data securely, to manage infrastructure and short-lived session storage, to measure how the Service is used, to monitor errors and performance, and to handle support email. We keep a current list of these providers at https://numbersandfigures.com/subprocessors.html, and we have a data-processing agreement in place with each of them.
• Discord: Discord operates the platform our Games run on. Discord gives us the profile and session information described above, and we send Discord what it needs to run the Activity, present your session, enable friend and presence features, and enforce its platform rules. Discord handles that data under its own privacy policy, not this one.
• Other players: The Service is social by design. Your Discord display name and avatar, the fact that you are in a session, and any content you submit in a Game are visible to the other players in that session.
• Analytics Providers: We share usage data with our analytics provider to measure engagement and retention, to understand in aggregate how features are used, to identify trends, and to decide what to build next. The events we send are labeled with a session identifier that cannot be linked back to you once the session ends. We do not disclose personal data we obtain through Discord’s programming interfaces to data brokers, to advertising networks, or to any other monetization service, and we do not sell or license it.
• Legal, Safety, and Enforcement: We may disclose personal data where we reasonably believe the law requires it, to respond to lawful requests from public authorities, to enforce our Terms of Service, to investigate cheating, harassment, or other abuse, and to protect the rights, safety, and property of our players, of Discord, or of us.
• Business Transfers: If we are involved in a merger, an acquisition, a financing, or a sale of assets, personal data may be transferred as part of that transaction. We will tell you before your personal data becomes subject to a different privacy policy.

How long do we keep your data?

We only keep your personal data as long as it’s required to provide you with the Service. Sometimes a longer period might be required by law.

After that, we will delete your personal data within a reasonable time.

Please note that we may retain some data, if necessary to:

• resolve disputes,
• enforce our user agreements,
• follow any technical and legal requirements related to the Service.

Children and Teens

Our Service is not directed to children under 13, and we do not knowingly permit children under 13 to use it or knowingly collect their personal data. If we learn we have collected personal data from a child under 13 without the consent required by law, we delete it. If you believe a child has provided personal data, contact us at contact@numbersandfigures.com.

Because our Games run only inside Discord, you reach them through a Discord account. Discord requires every account holder to be at least 13 years old and to meet the minimum age required by the laws of their country, which is higher in some countries. We direct our Games to players who meet that requirement and we rely on Discord’s age gate. We do not run a separate age check of our own.

Depending on where you live, certain other policies may apply with respect to minors:

US Residents

• California: we will not sell or share the personal data of a consumer we know to be 13 to 15 years old without their opt-in consent.
• New Jersey: for consumers we know to be at least 13 and younger than 17, we obtain consent before any sale, targeted advertising, or covered profiling.
• Connecticut: for consumers we know (or willfully disregard) to be at least 13 and younger than 18, we do not sell personal data, deliver targeted advertising, or conduct covered profiling.
• Other states, including Maryland, impose heightened restrictions for known minors under 18, and we apply them where required.

EU/EEA: where processing relies on consent offered directly to a child, the digital-consent age is 13 to 16 depending on the member state; below the applicable age we make reasonable efforts to obtain or verify parental consent, or we do not offer the feature.

UK: for services likely to be accessed by children we apply age-appropriate measures under the UK Children’s Code, including high-privacy defaults, data minimization, and limits on profiling.

Your Rights and Choices

We believe in giving users control over their personal data. This section outlines your rights (some of which may be based on where you reside) and how to exercise them.

All Users

Regardless of your location, you have the right to:

• Request deletion of your personal data
• Opt out of marketing communications
• Get a copy of the personal data we hold about you
• Control cookies and local storage through your browser or Discord client settings

EU and UK Residents

We are regulated under the General Data Protection Regulation (GDPR), which applies across the European Union. We are responsible as a controller of personal data for GDPR purposes.

If you are in the EU/EEA or the UK, you have rights under the GDPR (and UK GDPR) to access, correct, delete, restrict, and port your personal data, to object to processing and withdraw consent, and to lodge a complaint with your supervisory authority. Additionally, UK residents have similar rights to the above under the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. For more information on your rights under the UK GDPR, you can visit the Information Commissioner’s Office (ICO) website at www.ico.org.uk.

US State Privacy Rights

Your rights depend on where you live, and we honor them where your state’s law provides them and applies to us. Not every right exists in every state (for example, Iowa and Utah provide neither a correction right nor a profiling opt-out).

Rights you may have

• Know and access the personal data we hold about you, including the categories, sources, purposes, and categories of third parties.
• Correct inaccurate personal data.
• Delete your personal data, subject to the exceptions permitted by applicable law (for example, completing a transaction you requested, security and fraud prevention, legal compliance, and exercising or defending legal claims).
• Receive a portable copy of your data.
• Opt out of the sale or sharing of personal data, targeted advertising, and certain profiling.

Sale, sharing, and targeted advertising

We do not sell or share your personal data as those terms are defined under US state privacy laws, and we do not process it for cross-context behavioral advertising.

How to exercise your rights

• For access, correction, deletion, and portability requests we may ask for information to verify your identity. Authorized agents may submit requests with proof of authority. We respond within 45 days, extendable once by 45 days where permitted.
• Opt-out requests (sale, sharing, and targeted advertising) are not subject to identity verification and take effect without the verified-request process.
• Where your state grants an appeal right, you may appeal a denial by replying to our decision or emailing contact@numbersandfigures.com. If you remain unsatisfied you may contact your state Attorney General.
• We will not discriminate against you for exercising these rights.

California residents (CCPA/CPRA)

California residents also have the right to know the specific pieces of personal data we hold, the right to opt out of the sale or sharing described above, rights under California’s “Shine the Light” law, and the minors’ opt-in rights described in the children’s section. Because we use any sensitive personal information only for purposes permitted by the CCPA, the “right to limit” the use of sensitive personal information is not triggered.

Canadian Residents

For Canadian residents, we handle personal information under PIPEDA and applicable provincial private-sector laws, including Quebec’s Law 25 and the Alberta and British Columbia PIPA. Under PIPEDA you may access and request correction of your personal information and withdraw consent, subject to legal or contractual limits that we will explain. Brazilian Residents

We are regulated under the Lei Geral de Proteção de Dados (“LGPD”), which applies to Brazilian residents.

If you are in Brazil, you have rights under the LGPD to confirm and access your personal data, correct or delete it, request anonymization or portability, be informed about how we share it, and withdraw consent. To exercise any of these, email contact@numbersandfigures.com.

These rights apply to any personal data collected or processed in Brazil, as well as any personal data processed for the purpose of providing goods or services in Brazil.

International Data Transfers

Our headquarters is in the United States.

No matter where you live, by using the Service your personal data may be processed and transferred in the United States.

Where we transfer personal data out of the EEA or the UK, we rely on appropriate safeguards with transfer-impact assessments and supplementary measures where needed, and we apply onward-transfer controls to our processors and other recipients. You can request information about these safeguards using the contact details below.

Security Measures

We have taken steps and put security measures in place to prevent the accidental loss or misuse of personal data.

For example, we limit access to those who have a genuine business need. Those processing your information will do so only in an authorized manner.

Lastly, we have procedures in place to deal with any suspected data security breach. We’ll notify you and any applicable regulator of a suspected data security breach when legally required.

We last updated this Privacy Policy on the date listed at the top of this document.

We may make further updates from time to time, which will be reflected in the latest version posted on the Service. For material changes, if we have your email address on file we will inform you via email. Otherwise, we will post a message on the Service about the change. For material changes to processing that relies on your consent, we will obtain fresh consent where required. We do not treat continued use as agreement to materially new processing.
